These Terms of Use (“Terms”) govern your access to and use of the WayCarrier website and mobile application (collectively, the “Platform”), owned and operated by WayCarrier. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

Use of the Platform

  • Eligibility: Use of the Platform is restricted to individuals who are at least 18 years of age.
  • Account Creation: To use certain features of the Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for any activity that occurs under your account.
  • Prohibited Conduct: You agree not to:
    • Use the Platform for any unlawful or unauthorized purpose.
    • Use the Platform in any way that could harm, disable, overburden, or impair the Platform or interfere with any other party’s use and enjoyment of the Platform.
    • Upload, post, or otherwise transmit any viruses, malware, or other harmful code.
    • Use any automated means, including scripts, robots, crawlers, or scrapers, to access, use, or copy any portion of the Platform.
    • Collect any personally identifiable information about other users without their consent.
    • Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
    • Violate any applicable laws or regulations.

Shipping Services

  • Platform Function: WayCarrier provides a platform for connecting shippers with couriers. WayCarrier does not provide shipping services directly.
  • Shipping Contracts: When you place a shipping order through the Platform, you are entering into a contract directly with the selected courier. WayCarrier is not a party to that contract.
  • Shipping Information: Shipping rates and estimated delivery times are provided by couriers and may be subject to change. WayCarrier does not guarantee the accuracy or reliability of such information.
  • Tracking: The Platform may offer live tracking of your shipments. WayCarrier makes reasonable efforts to ensure the accuracy of tracking information, but cannot guarantee its accuracy or completeness.

Live Chat Support

  • Availability: The Platform may offer a live chat feature for you to communicate with customer support.
  • Disclaimer: Live chat is intended for general inquiries and support. It may not be suitable for urgent or time-sensitive matters.

Intellectual Property

  • Ownership: The Platform and all content on the Platform, including but not limited to text, graphics, logos, images, and software, are owned by WayCarrier or its licensors and are protected by copyright, trademark, and other intellectual property laws.
  • Use Restrictions: You may not use, reproduce, distribute, modify, transmit, or display any content from the Platform without the prior written consent of WayCarrier.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WAYCARRIER DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

IN NO EVENT SHALL WAYCARRIER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA LOSS, BUSINESS INTERRUPTION, AND LOSS OF GOODWILL.

Indemnification

You agree to indemnify and hold harmless WayCarrier and its affiliates, officers, directors, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and defense costs, arising out of or relating to your use of the Platform, your violation of these Terms, or your violation of any rights of another.

Changes to These Terms

WayCarrier may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the Platform. You are advised to review these Terms periodically for any changes.

Severability
